摘要:: 在中国传统社会，家族制度一直是维护基层社会基本秩序的有效手段。清末民初时期，中国社会发生巨变，传统法律被迫走上了近代化的道路。在中国传统法律的转型过程中，家制成为传统与现代冲突最为激烈的矛盾点，因而对于传统家制法律层面的改造，立法者尤为慎重。北洋政府时期，各方政治力量的博弈导致整个社会法制呈现混乱失序的状态，但是该时期的立法建设始终未曾中断，而基于稳定社会基本秩序的需要，对传统家族制度进行法律层面的改造成为该时期屡次立法尝试的重点领域。

Abstract:: In traditional Chinese society, the family system effectively maintained the basic social order at the grassroots level. During the late Qing Dynasty and early years of the Minguo period, China underwent profound changes, and the traditional law was forced to take the path towards modernization. The family system thus became the polarity between the traditional and modern laws of China in the legal transformation. As a result, legislators were particularly cautious about transforming the traditional Chinese family law. Under the Beiyang government, the political game led to chaos and disorder in the legal system of the society. However, the legislative construction was not interrupted. Moreover, the legal reformation of the traditional family system proved to be a key area of legislation during this period in order to stabilize the basic social order.
