摘要:
《名公书判清明集》记载各种土地交易纠纷，出现基于砧基籍的判例和判决。砧基籍是田产底账，具备土地物权登记簿册的全部法律要素，是南宋土地交易的规范化表现。砧基籍实行以“宗地”加“人户”为单位的土地登记。砧基籍是南宋不动产所有权登记证书，具有对物权记载事项的绝对证明效力。不符合砧基籍范式、追毁文书公据、在虚假文书上批凿的纠纷，按照砧基籍管业判决。砧基籍在司法审判中起到证明田土产权、土地权利正确性等物权登记效力。
Abstract:
“The Enlightened Judgments by Famous Judges” relates different disputes of land transaction. It also records judicial precedent and judgments. “Zhenjiji” has been land account which has essential legal elements of land registration. It is the normative reflection of land transactions. Zhenjiji implemented a measure to plus "land" and "households" as the unit of land registration. It is the real estate ownership registration certificate with the absolute effectiveness. Not following format、destroying documents or proving a false document would be held accountable. In the judicial trial Zhenjiji had real right effect on proving the land property rights and other legitimate rights.
